Notification No. 15/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18

This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.

Practical effect: Chennai contractors working for boards, corporations and government companies moved to 18 per cent from 1 January 2022, and should have raised price-variation claims for contracts signed earlier.

The Supreme Court held that where a manufacturer reverses credit taken on inputs used in exempted goods, the position is as though no credit was ever taken. The exemption benefit therefore cannot be denied. Maintaining separate accounts is one method of compliance, but a debit entry reversing the credit achieves the same result. Substance rather than the form of book entries governs the outcome.

If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Mugalivakkam as urgent.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows.
