The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

Circular No. 225/19/2024-GST · 2024-07-11

Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it.
