GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.

The department refused rectification. The High Court held that a taxpayer cannot be left without a remedy for a bona fide error where the tax was in fact paid and no revenue was lost, and directed the authorities to allow the correction so that the liability and the recipient's credit were properly reflected.

CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises.
