The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.
What to do about it: A clerical overstatement in GSTR-1 by a Chennai supplier can still be corrected long afterwards, provided the recipient has not taken the excess credit and the Circular 212 procedure is followed.

Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.
Why this matters: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.
Circular No. 225/19/2024-GST · 2024-07-11
Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
What to do about it: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.
