Resolving a conflict between the Gujarat and Madras High Courts, the Supreme Court upheld Section 54(3)(ii) and Rule 89(5), holding that refund of unutilised ITC under the inverted duty structure is confined to ITC on input goods; credit on input services is not refundable. The Court affirmed the Madras High Court view in Transtonnelstroy Afcons, while urging the GST Council to revisit anomalies in the refund formula.
What it means for you: Businesses with inverted duty structures — such as footwear, textiles or fertiliser dealers — should compute refund claims on input goods only and plan procurement to minimise unrefundable service credits.
Notification No. 7/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13
This companion notification amended the exemption list so that the nil rate on cereals, pulses, flour and similar staples applies only where the goods are other than pre-packaged and labelled. Loose sale from an open sack or gunny bag remains exempt; the same commodity in a sealed retail pack bearing statutory declarations becomes taxable at five per cent. Both notifications came into force on 18 July 2022 and reshaped billing for every kirana and provision supplier.
What it means for you: The same bag of rice is nil-rated if sold loose and taxable at five per cent if sold in a labelled retail pack, so packing practice now decides the tax.
35th GST Council Meeting, New Delhi — 21 June 2019 · 2019-06-21
At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.
Practical effect: Every later e-invoicing threshold reduction, down to the Rs 5 crore limit now applicable, traces back to this decision, so businesses crossing a threshold must set up e-invoicing from the first day of the next financial year.
