CBIC clarified that granting a loan or advance between related persons, including by an overseas affiliate to its Indian affiliate, is a supply of service, but the consideration for that service is represented only by interest or discount, which is exempt. Where no processing fee, service fee or administrative charge is levied, there is no taxable consideration, and no notional interest can be imputed merely because the parties are related. GST applies only to fees actually charged.

What it means for you: Group companies extending interest-free funding to each other owe no GST, but any documentation or processing fee charged is taxable and must be invoiced.

Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

What it means for you: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.

Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.

At what amount of tax evasion can GST prosecution be launched?

If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. We advise Padi businesses to check both tabs at least once a month, because a reply deadline starts running from the date of issue on the portal, not from when you happen to see it.
How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Track every submission with an acknowledgment, because the commencement date and the timeline arguments may matter later if disputes arise.
How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. Consistency matters more than frequency.
What discrepancies usually trigger a GST scrutiny notice?

What is the GST rate on a works contract for a commercial building?

I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. An amount deposited under one combination, say CGST-penalty, cannot be directly used to pay under another, say IGST-tax, which is why your balance appears unusable despite money lying in the ledger. The remedy is Form PMT-09, which transfers the amount to the correct head instantly without any officer approval.
