33rd GST Council Meeting, New Delhi — 20 and 24 February 2019 · 2019-02-24
To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.
What to do about it: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.

CBIC notified a special procedure under Section 148 for manufacturers of pan masala, unmanufactured tobacco, chewing tobacco, zarda and similar products. Such manufacturers must declare details of every packing machine, its make, capacity and installation address, in Form GST SRM-I within the prescribed time, report any addition or removal of machines, and file a monthly statement of inputs and outputs in Form GST SRM-II. The procedure took effect from 1 April 2024 and carries a separate penalty for unregistered machines.
What to do about it: Any Chennai unit packing tobacco or pan masala products must register every machine in SRM-I and file SRM-II monthly, entirely separate from its normal GST returns.

Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.
Why this matters: Namkeen and extruded snack manufacturers must apply the clarified rate prospectively and can rely on the circular's regularisation for earlier supplies.
