A vehicle carrying laboratory equipment was seized because the consignee address on the invoice did not match the address on the GST registration, and a demand of Rs. 12,46,678 was raised. The Madras High Court allowed the writ petition, finding no attempt to evade tax: the supplier had issued a proper tax invoice and e-way bill, tax compliance during transportation was established, and the address in question was subsequently added to the registration.

What it means for you: Keep your additional places of business updated on the registration, but if a consignment is detained on this ground the penalty can be resisted where no evasion is shown.

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Padi businesses, since no appeal is provided against DRC-22. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
