The change was to take effect from 1 January 2022 and triggered strong protests from the textile trade, including in Tiruppur, Erode and Coimbatore.

Circular No. 186/18/2022-GST · 2022-12-27

The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.

If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Scrutiny can be closed with a good reconciliation; an audit needs sustained document management and negotiation over weeks. Both, if unresolved, end in Section 73 or 74 demands, so early professional handling pays.
How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Palavakkam demand case.
How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends.
