As in the first wave, the five per cent restriction on credit for invoices not uploaded by suppliers was not applied separately to April and May 2021. The condition was to be applied cumulatively for those two periods and the cumulative adjustment made in the GSTR-3B for May 2021. The same notification extended the window for using the invoice furnishing facility for April 2021 to twenty-eight days from the end of the month, so that recipients were not deprived of credit.
What it means for you: Month-wise ITC mismatch computations for April and May 2021 are legally incorrect, and this notification is the answer to a scrutiny notice covering those months.

Because the GST Appellate Tribunal was not yet operational, CBIC directed that taxpayers who lost their first appeal could pay the additional pre-deposit required for a Tribunal appeal through the electronic liability register and file an undertaking to appeal once the Tribunal starts functioning. On doing so, recovery of the balance confirmed demand stands stayed under Section 112(9). Officers were told not to coerce full payment merely because the appellate forum was unavailable.
Why this matters: After an unfavourable first-appeal order, paying the ten per cent Tribunal pre-deposit with an undertaking legally halts recovery until GSTAT hears the case.

The Supreme Court held that composite works contracts, involving both supply of goods and rendering of services, could not be taxed under the pre-2007 service tax categories such as commercial or industrial construction. A specific charging and valuation mechanism was necessary, and this came only with the works contract service entry introduced on 1 June 2007. Demands for earlier periods on composite contracts were accordingly set aside.
Why this matters: Chennai contractors still defending legacy service tax demands on composite contracts for pre-2007 periods have a strong precedent in their favour.
