A resolution plan that simply ignores statutory tax dues, or provides nil recovery to the State, can be rejected. The decision considerably strengthened the position of tax authorities in corporate insolvency resolution processes.

Schedule IV at 1.5 per cent central tax, that is three per cent combined, covers pearls, silver, gold, platinum, base metals clad with precious metal, articles of jewellery, goldsmiths' and silversmiths' wares, imitation jewellery and coin. Schedule V at 0.125 per cent, that is 0.25 per cent combined, covers rough or simply sawn diamonds and unworked precious and semi-precious stones. A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
