GSTN advised that under Rule 10A of the CGST Rules, registered taxpayers must furnish valid bank account details within 30 days of registration or before filing GSTR-1 or IFF, whichever is earlier. From 1 September 2024 the portal blocks GSTR-1 and IFF filing for taxpayers whose bank account details are not available and validated on the portal. The measure targets fraudulent registrations created without genuine banking trails.
Practical effect: Newly registered businesses should add and validate their bank account on the portal immediately after registration to avoid a filing blockage.
M/s. Prime Gold International Ltd v. Additional Director General — Madras High Court, W.P. No. 8203 of 2022, decided 2 August 2023 (C. Saravanan J.) · 2023-08-02
The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.
Why this matters: A Chennai business should diarise the date of any Section 83 attachment — after twelve months the bank must release the account, and a fresh order is required if the department wants to continue.
Notification No. 12/2017-Central Tax dated 28.06.2017 · 2017-06-28
This notification prescribed the number of digits of the Harmonised System of Nomenclature code to be shown on a tax invoice, keyed to the turnover in the preceding financial year. Businesses up to Rs 1.5 crore were not required to show any HSN code, those between Rs 1.5 crore and Rs 5 crore had to show two digits, and those above Rs 5 crore had to show four digits.
