Roshan Fruits India (P) Ltd v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 10008 of 2024, decided 16 April 2024 (Senthilkumar Ramamoorthy J.) · 2024-04-16

An assessment order for 2019-20 alleged wrongful availment of input tax credit, and the taxpayer's rectification petition, which annexed a detailed reconciliation between GSTR-2A and GSTR-3B, was simply left undecided by the department. The Madras High Court recorded that the reconciliation had been furnished and directed the officer to consider and dispose of the rectification petition dated 12 March 2024 by a speaking order, after affording a reasonable opportunity to the taxpayer, within one month.

What it means for you: If you have filed a rectification application with a proper 2A versus 3B reconciliation and heard nothing, the department can be compelled to pass a reasoned order.

Notification No. 89/2020-Central Tax · 2020-11-29

Recognising that large suppliers needed time to configure their billing systems, CBIC waived the penalty under Section 125 for failure to comply with the dynamic QR code requirement on business-to-consumer invoices issued between 1 December 2020 and 31 March 2021. The waiver was conditional on the supplier complying with the requirement from 1 April 2021 onwards. Similar conditional waivers were issued in later years as the deadline was pushed further.

What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in Ponneri have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?

Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Ponneri as urgent.

What is self-invoicing under RCM and is there a time limit for it?

No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Ponneri on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed.
