Circular No. 130/49/2019-GST dated 31.12.2019 · 2019-12-31

CBIC explained the scope of the reverse charge entry on renting of motor vehicles. It clarified that the entry applies where the supplier is any person other than a body corporate who pays tax at 5 per cent, supplies the service to a body corporate, and does not issue an invoice charging tax at 12 per cent with full input tax credit. Where the supplier is itself a body corporate, or charges 12 per cent, the recipient has no reverse charge liability.

A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.

Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. What are the GST rates on gold, silver and diamond jewellery?
The special rates on precious metals were retained in the GST 2.0 restructuring. Gold, silver and articles of jewellery attract 3 percent GST, rough and unworked diamonds attract 0.25 percent, and jewellery making charges billed separately attract 5 percent. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice. Old gold purchased from an unregistered customer in exchange transactions does not attract GST in the customer's hands, but valuation of the net supply must be documented carefully.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation.
