The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
What it means for you: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.
GSTN Advisory dated 23 August 2024 — introduction of the RCM Liability/ITC Statement · 2024-08-23
GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.
Why this matters: Reconcile reverse charge payments with the credit taken every month, since the department can now see an RCM ledger for your GSTIN.

CBIC explained the scope of the reverse charge entry on renting of motor vehicles. It clarified that the entry applies where the supplier is any person other than a body corporate who pays tax at 5 per cent, supplies the service to a body corporate, and does not issue an invoice charging tax at 12 per cent with full input tax credit. Where the supplier is itself a body corporate, or charges 12 per cent, the recipient has no reverse charge liability.
What it means for you: Chennai companies should obtain a written confirmation of the rate and constitution of their cab operator, since that single fact decides who pays the tax.
