The company made bona fide clerical errors in its GSTR-1 which prevented its customer from taking credit, and the portal would not permit correction after the statutory deadline had passed. The High Court held that GST is a technology-driven regime intended to be taxpayer-friendly, that a genuine error causing no loss of revenue ought to be permitted to be corrected, and directed the authorities to allow rectification of the returns for the relevant period.
What to do about it: Where a GSTR-1 error is blocking your customer's credit, a rectification request supported by this judgment is worth making even after the statutory deadline.
Entry 18, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
Entry 18 exempts transportation of goods by road and by inland waterways, but carves out two categories: a goods transport agency and a courier agency. The practical effect is that a truck owner who simply carries goods without issuing a consignment note supplies an exempt service, while a transporter who issues a consignment note becomes a goods transport agency and his service is taxable, usually in the hands of the recipient under reverse charge. The consignment note is therefore the dividing line between exemption and taxability.
What it means for you: Before paying reverse charge on a Chennai freight bill, check whether the transporter actually issued a consignment note, because a plain lorry hire without one is exempt.
GSTN Advisory dated 14 November 2023 — input tax credit reversal under Rule 37A of the CGST Rules for FY 2022-23 · 2023-11-14
Rule 37A requires a buyer to reverse input tax credit where the supplier reported the invoice in GSTR-1 but did not file the GSTR-3B for that tax period by 30 September following the end of the financial year. The reversal must be made in the GSTR-3B filed on or before 30 November. GSTN made supplier-wise details of such invoices available on the portal and advised taxpayers to complete the reversal for FY 2022-23 by 30 November 2023. The credit can be reclaimed once the supplier files the pending return.
What it means for you: Run a supplier compliance check every October, because credit from a defaulting supplier must be reversed by 30 November or carries interest.
