It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

For online services supplied to unregistered persons, including OIDAR services, online gaming and subscriptions, CBIC clarified that the supplier must record the recipient's State on the tax invoice, which is then deemed the address on record for determining place of supply under Section 12(2)(b). Failure to collect and record the State means incorrect place of supply, wrong apportionment of tax between States, and exposure to penal action under Section 122(3)(e).
Why this matters: Any business selling digital services or subscriptions to consumers must capture the customer's State at checkout and print it on invoices, or face penalties and tax reallocation disputes.

From the August 2022 return period the whole of the credit appearing in GSTR-2B must first be reported as credit available in Table 4(A), with ineligible and reversible credit then shown separately in Table 4(B). Reversals that can be reclaimed later, such as those under Rule 37, go into Table 4(B)(2) and the reclaim is reported in Table 4(D)(1). Only the net figure reaches the electronic credit ledger.
