The Supreme Court held that for invoking the extended period of limitation, suppression must be wilful. It means a deliberate act of withholding information which the assessee knew he was obliged to disclose. Where facts were within the department's knowledge, or the assessee acted on a bona fide understanding, the charge of suppression fails. The word must be read with the accompanying words fraud, collusion and wilful misstatement.

This notification exempted all registered persons other than those paying tax under the composition levy from paying GST at the time of receipt of an advance towards a supply of goods. Instead, tax is payable at the time of issue of the invoice, or when the invoice ought to have been issued, under section 12(2)(a). The earlier partial relief limited to suppliers with turnover up to Rs 1.5 crore was superseded and extended to everyone.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
Why this matters: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.
