This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. Most items at 12 per cent moved to 5 per cent and most at 28 per cent moved to 18 per cent. The new rates took effect from 22 September 2025 and remain in force.

Goodwill Industrial Canteen - AAR Tamil Nadu, Order No. TN/09/AAR/2018, dated 30 August 2018 · 2018-08-30

The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Is there a late fee for filing GSTR-1 after the 11th?

What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot. Unlike the old VAT regime, GST allows the entire input tax credit on capital goods in the month of receipt, provided the machinery is used for taxable supplies and the invoice appears in your GSTR-2B. The one critical condition sits in Section 16(3): if you claim income tax depreciation on the GST component of the asset's cost, the credit is denied. So capitalise the machine at its value excluding GST, claim the GST as credit, and depreciate only the net cost. Why is my nil return SMS to 14409 not working?

For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. If your business deals in any of these lines, pricing and working capital need careful planning.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items.
