Union of India v. Bharti Airtel Ltd — Supreme Court, 2021 · 2021-10-28

Bharti Airtel sought to rectify its GSTR-3B for July-September 2017 to claim refund of about Rs 923 crore excess cash paid, blaming the non-operational GSTR-2A at the time. The Supreme Court set aside the Delhi High Court order permitting rectification, holding that returns can only be corrected in the period in which errors are noticed, as the law then stood, and that taxpayers must self-assess from their own books, not the portal.

The portal now validates HSN entries against its master list, so wrong or truncated codes can block filing. I made a mistake in GSTR-3B. Can I revise it?

CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. Where the manufacturer ultimately destroys the expired stock, input tax credit relating to the destroyed goods must be reversed under Section 17(5)(h). We are constructing our own office building in Puzhuthivakkam. Can we claim ITC on the materials and contractor bills?
No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. So credit on a March 2026 invoice must be taken in a GSTR-3B filed on or before 30 November 2026. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Puzhuthivakkam.
How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies.
