The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

Circular No. 137/07/2020-GST dated 13 April 2020 · 2020-04-13

CBIC answered questions arising from cancelled bookings and returned goods. Where an advance was received, tax paid and an invoice issued, and the contract was later cancelled, the supplier issues a credit note under section 34 and adjusts the liability; where only a receipt voucher was issued, he issues a refund voucher and claims refund of the excess tax paid in FORM GST RFD-01. It also confirmed that a Letter of Undertaking for 2020-21 could be filed up to 30 June 2020 while quoting the previous year's LUT number.

Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
