Following the 56th GST Council meeting, CBIC clarified the treatment of secondary and post-sale discounts. Where a supplier issues a financial or commercial credit note without adjusting GST, the dealer need not reverse input tax credit, since the tax originally charged stands unchanged. Discounts given to dealers are not consideration for any service by the dealer merely because they aid sales, unless a specific agreement obliges the dealer to perform defined promotional activities for separate consideration.

CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.
