Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24

This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. How will I know my scrutiny reply has been accepted by the GST officer?

From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now.
