The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.

CBIC answered questions arising from cancelled bookings and returned goods. Where an advance was received, tax paid and an invoice issued, and the contract was later cancelled, the supplier issues a credit note under section 34 and adjusts the liability; where only a receipt voucher was issued, he issues a refund voucher and claims refund of the excess tax paid in FORM GST RFD-01. It also confirmed that a Letter of Undertaking for 2020-21 could be filed up to 30 June 2020 while quoting the previous year's LUT number.

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.
What to do about it: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.
