The GST Appellate Tribunal's e-filing portal at efiling.gstat.gov.in became operational on 24 September 2025, finally giving taxpayers a forum for second appeals against orders of appellate and revisional authorities. Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.
What to do about it: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.
