The officer issues a statement in FORM GST MOV-01, an order of inspection in MOV-02, records the inspection report in Part A of FORM GST EWB-03 within twenty-four hours and the final report in Part B within three days, and then releases the goods in MOV-05 or issues a detention order in MOV-06 with a notice in MOV-07. Confiscation follows in MOV-10 and MOV-11.

Notification No. 63/2020-Central Tax · 2020-08-25

This notification brought into force, with effect from 1 September 2020, the amendment to Section 50 of the CGST Act made by the Finance (No. 2) Act, 2019. The amendment provides that where a return is filed late, interest is charged only on that portion of the tax liability which is discharged in cash through the electronic cash ledger, and not on the part settled from input tax credit. Because it was made effective only prospectively, it caused considerable litigation over earlier periods.

Practical effect: For any delayed GSTR-3B, interest should be computed on the cash component alone, and a gross-liability interest demand should be challenged.

No deficiency memo within fifteen days means the refund claim must be processed

Jian International v. Commissioner of Delhi Goods and Services Tax — Delhi High Court, judgment dated 22 July 2020, reported at 2020 SCC OnLine Del 2606 · 2020-07-22

The refund application was neither processed nor returned with a deficiency memo in Form RFD-03 within the fifteen days allowed by Rule 90, and objections were raised only much later. The High Court held that if no deficiency memo is issued within fifteen days the application must be treated as complete and taken up for processing, and the department cannot keep raising fresh deficiencies afterwards. The refund was directed to be paid along with interest.

Practical effect: Diarise the fifteenth day after filing a refund application — silence beyond that date is a strong ground to press for payment.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?

Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Royapettah as urgent.
At what amount of tax evasion can GST prosecution be launched?

How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise. Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. My customer in Mumbai asked me to deliver goods directly to his buyer in Royapettah. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point.
