The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.
What it means for you: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

A vehicle carrying laboratory equipment was seized because the consignee address on the invoice did not match the address on the GST registration, and a demand of Rs. 12,46,678 was raised. The Madras High Court allowed the writ petition, finding no attempt to evade tax: the supplier had issued a proper tax invoice and e-way bill, tax compliance during transportation was established, and the address in question was subsequently added to the registration.
What to do about it: Keep your additional places of business updated on the registration, but if a consignment is detained on this ground the penalty can be resisted where no evasion is shown.

CBIC clarified that granting a loan or advance between related persons, including by an overseas affiliate to its Indian affiliate, is a supply of service, but the consideration for that service is represented only by interest or discount, which is exempt. Where no processing fee, service fee or administrative charge is levied, there is no taxable consideration, and no notional interest can be imputed merely because the parties are related. GST applies only to fees actually charged.
Why this matters: Group companies extending interest-free funding to each other owe no GST, but any documentation or processing fee charged is taxable and must be invoiced.
