The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution. Only a discriminatory tax that favours local goods over goods from other States is hit. The judicially created concept of compensatory tax was discarded as having no constitutional basis. Rule 8 of the CGST Rules was amended to support this risk-based process.
