46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31

The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.

CBIC Instruction No. 03/2025-GST · 2025-04-17

Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

The Supreme Court held that where a manufacturer reverses credit taken on inputs used in exempted goods, the position is as though no credit was ever taken. The exemption benefit therefore cannot be denied. Maintaining separate accounts is one method of compliance, but a debit entry reversing the credit achieves the same result. Substance rather than the form of book entries governs the outcome.

Practical effect: A Chennai business making both taxable and exempt supplies can protect its position by reversing the proportionate credit properly and documenting the reversal.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. Yes, Section 62 contains a self-correcting mechanism. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Sembium cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.

How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. Most professional, business support and repair services billed by professional firms continue at 18 percent with full input tax credit.
How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. What is the GST rate for restaurants and food delivery now?
Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it.
