Inverted duty structure in textiles and footwear to be corrected from 1 January 2022

45th GST Council Meeting, Lucknow — 17 September 2021 · 2021-09-17

The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.

What to do about it: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.

Handicrafts re-notified at 5 per cent, with silver filigree and imitation jewellery at 3 per cent

Notification No. 13/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

This notification replaces the entire table in the 2018 handicrafts notification with a fresh list of about thirty-nine entries from 22 September 2025. Most items carry central tax of 2.5 per cent, that is five per cent combined: handcrafted candles, carved and inlaid wood products, wooden frames, art ware of cork and sholapith, vegetable-fibre mats and basketwork, handmade paper, papier mache articles, coir goods, handmade carpets, stone carving, ceramic and glass art ware, brass and copper art ware, wooden toys, hand paintings and original sculptures. Silver filigree work and handmade imitation jewellery, including jewellery of natural seeds and beads, carry 1.5 per cent central tax, that is three per cent combined.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
What are the exact steps to file a DRC-03 voluntary payment on the GST portal?
Log in and go to Services, then User Services, then My Applications, choose Intimation of Voluntary Payment DRC-03 and click New Application. Select the cause of payment, such as voluntary, show cause notice, audit or annual return, pick the section and financial year, and enter the tax, interest and penalty amounts head-wise under IGST, CGST and SGST. A saved draft remains available for fifteen days. Offset the amounts from your ledgers, sign with DSC or EVC, and download the ARN acknowledgement. What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Sembium cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a Sembium seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.
Is GST payable on hostel or paying guest accommodation in Sembium?

The tenant, if registered and using the premises for business, can claim the GST as input tax credit, since renting is not a blocked credit. Landlords with several small commercial properties often cross the threshold without realising it, because rent from all properties on the same PAN is clubbed. A yearly turnover check protects against retrospective demands.
What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
What are the common types of GST notices a business can receive?

Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
