A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.

What to do about it: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. Errors in GSTR-1 can be amended in the following period's return. Practically, this means credit notes need commercial agreement before they are reported, not after. Keep an email trail with the buyer, confirm they will reverse the credit in their GSTR-3B, and reconcile IMS actions monthly. Should I choose QRMP or continue monthly filing?

Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Semmancheri architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies.
