The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.
What it means for you: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.

An SEZ unit had accumulated unutilised IGST credit distributed to it by its Input Service Distributor. The refund was rejected on the ground that Rule 89 permits only the supplier to SEZ to claim refund. The High Court allowed the refund of about Rs. 99 lakh, holding that where an ISD has already distributed the credit there is no supplier who can claim it, and that a circular cannot override Section 54 of the CGST Act to leave the credit permanently stranded.
Practical effect: If credit is genuinely stuck with no other route to recover it, a rigid reading of the refund rules or a circular is not a valid ground for rejection.

This notification made the Central Goods and Services Tax Rules, 2017. In its original form it carried the chapters on preliminary definitions, composition levy and registration, together with the associated forms in the REG and CMP series.
