Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.

Section 16(5)/(6) ITC relaxation and Section 128A waiver brought into force

Notification No. 17/2024-Central Tax · 2024-09-27

CBIC appointed 27 September 2024 as the commencement date for the first tranche of Finance (No. 2) Act, 2024 GST amendments, including Section 118 of that Act which inserted Sections 16(5) and 16(6) of the CGST Act. Those provisions retrospectively allow input tax credit for FY 2017-18 to 2020-21 if claimed in any GSTR-3B filed up to 30 November 2021, and restore credit where returns were filed after revocation of cancellation. The bulk of the remaining amendments, including the Section 128A interest and penalty waiver scheme, were brought into force from 1 November 2024.

What it means for you: Demands built purely on the old Section 16(4) time limit for 2017-18 to 2020-21 became legally unsustainable from this date, so contest or seek rectification of any such order.

Owing to a mistake, the company's GSTR-3B for one month was filed showing nil figures even though the tax had actually been paid, and the portal offered no way to correct it. The department refused rectification. The High Court held that a taxpayer cannot be left without a remedy for a bona fide error where the tax was in fact paid and no revenue was lost, and directed the authorities to allow the correction so that the liability and the recipient's credit were properly reflected.

What to do about it: A genuine reporting error in GSTR-3B is worth pressing before the department rather than absorbing — courts have ordered correction where no tax was actually short paid.

It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in T. Nagar have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What documents do GST audit officers usually ask for?
Expect to produce the GSTR-1, GSTR-3B and GSTR-9 filings for the audit years, audited financial statements, trial balance, sales and purchase registers, ITC ledgers with supplier-wise detail, fixed asset register, e-way bill data, bank statements, key customer and vendor agreements, stock records and reconciliations between books and returns. Officers in Tamil Nadu commonly probe ITC on blocked credits under Section 17(5), reverse charge compliance, classification and rate issues, and turnover differences with income tax filings. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths.
