The Central Goods and Services Tax (Fourth Amendment) Rules, 2021 made several refund changes. Rule 90 was amended so that the period from the filing of a refund application in Form GST RFD-01 to the communication of the deficiency memo in Form GST RFD-03 is excluded when computing the two-year limitation for the fresh application filed after rectifying the deficiencies. A new facility to withdraw a refund application in Form GST RFD-01W before an order is passed was introduced, with the debited amount credited back to the ledger.
Why this matters: A Chennai exporter who receives a deficiency memo does not lose limitation for the fresh claim, and this amendment is the authority to cite if the officer says otherwise.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.
What it means for you: If a Chennai company is under moratorium, indirect tax officers may quantify dues but cannot attach property or auction goods to recover them.

GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
What it means for you: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.
