CBIC clarified the mechanics of the new section 9(5) liability for restaurant services supplied through electronic commerce operators. It confirmed that the operator is not required to collect tax at source on such supplies, that the operator must pay the tax in cash without using input tax credit, that the restaurant need not register merely because it supplies through an operator if it is otherwise below the threshold, and that the operator must issue the invoice for those supplies. It also clarified the treatment of the operator's own delivery charges.
What it means for you: Chennai restaurants on delivery platforms should reconcile the platform's monthly statement against their own books before filing, to avoid double payment or an unexplained turnover gap.

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.
Practical effect: The tax gap between an electric two-wheeler at five per cent and a petrol motorcycle at eighteen per cent is now the single biggest pricing lever for Chennai vehicle dealers.
35th GST Council Meeting, New Delhi — 21 June 2019 · 2019-06-21
At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.
Practical effect: Every later e-invoicing threshold reduction, down to the Rs 5 crore limit now applicable, traces back to this decision, so businesses crossing a threshold must set up e-invoicing from the first day of the next financial year.
