Notification No. 38/2017-Central Tax (Rate) dated 13.10.2017 · 2017-10-13
Responding to widespread compliance difficulty, this notification amended Notification 08/2017-Central Tax (Rate) to remove the daily Rs 5,000 limit and exempt all intra-State supplies of goods or services received by a registered person from an unregistered supplier from tax under section 9(4), up to 31 March 2018. In effect it suspended the unregistered-purchase reverse charge entirely rather than merely raising the threshold.
Practical effect: Chennai businesses have not had to pay reverse charge on ordinary purchases from unregistered vendors since 13 October 2017, and the suspension was repeatedly extended before becoming permanent.

It also reset Table 4. Total credit as per GSTR-2B is taken in Table 4(A), permanent reversals such as Rules 42 and 43 and blocked credit under Section 17(5) are shown in Table 4(B)(1), temporary reversals in Table 4(B)(2), and credit reclaimed later is shown in 4(A)(5) with 4(D)(1).

The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.
