Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
What it means for you: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.

CBIC waived the late fee for furnishing the outward supply statement in Form GSTR-1 for the months of March, April and May 2020 and for the quarter ending 31 March 2020, provided the statement was filed on or before 30 June 2020. The relief covered both monthly and quarterly filers. Because GSTR-1 late fee is separate from GSTR-3B late fee, this notification had to be issued in addition to the GSTR-3B waiver of the same date.
Why this matters: A Chennai supplier who filed the March to May 2020 GSTR-1 by 30 June 2020 owes nothing by way of late fee, whatever the portal ledger may currently show.

The taxpayer argued that Rule 86A permits blocking only of credit actually available in the ledger, so a negative block was without jurisdiction. Departing from the Gujarat and Delhi High Court view, the Madras High Court adopted a purposive reading and held that 'available' means credit that was available at any point of time for debit, so negative blocking is permissible. It also held that Central and State authorities may act independently for different periods and amounts. The petition was dismissed.
What it means for you: Chennai taxpayers cannot resist a Rule 86A block merely because the ledger balance is nil; the answer lies in producing supplier documents and seeking unblocking on merits.
