A Division Bench of the Madras High Court upheld the validity of Section 54(3)(ii) CGST Act and Rule 89(5), holding that Parliament consciously restricted refund of unutilised ITC under the inverted duty structure to credit accumulated on input goods, and that excluding input services from the refund formula is neither ultra vires nor unconstitutional. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.
