It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?

How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
Is GST payable on my YouTube AdSense earnings?
AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST.
