CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.
Why this matters: Apartment associations across Chennai should test both the Rs 20 lakh turnover and the Rs 7,500 per-flat tests, and remember that crossing the limit taxes the whole amount.

The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.
Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.
Why this matters: If a Chennai company is under moratorium, indirect tax officers may quantify dues but cannot attach property or auction goods to recover them.
