The Supreme Court held that mobile telecom towers and prefabricated shelters are not immovable property. They are fixed to the earth only for stability, can be dismantled and relocated without damage, and are therefore intrinsically movable goods. Consequently they qualify as capital goods or inputs and CENVAT credit on them is allowable. The reasoning on the movable versus immovable test is regularly applied to input tax credit disputes under GST as well.

Notification No. 66/2017-Central Tax dated 15.11.2017 · 2017-11-15

This notification exempted all registered persons other than those paying tax under the composition levy from paying GST at the time of receipt of an advance towards a supply of goods. Instead, tax is payable at the time of issue of the invoice, or when the invoice ought to have been issued, under section 12(2)(a). The earlier partial relief limited to suppliers with turnover up to Rs 1.5 crore was superseded and extended to everyone.

At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
