CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

The Council announced an amnesty scheme reducing late fee on pending GSTR-3B returns for the tax periods from July 2017 to April 2021. For taxpayers with no tax liability in those periods the late fee was capped at Rs 500 per return, and for others at Rs 1,000 per return, in each case counting central and state tax together. The reduced late fee applied only where the returns were furnished between 1 June 2021 and 31 August 2021, a window later extended to 30 November 2021.

What to do about it: Taxpayers who cleared four years of pending returns in this window paid a fraction of the statutory late fee, which is why acting promptly in an amnesty window matters so much.

In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
The deadline is counted from the date of the debit note, not the original invoice. After the Finance Act 2020 delinked debit notes from their underlying invoices, ITC on a debit note can be claimed up to 30 November following the end of the financial year in which the debit note itself was issued. So a debit note dated June 2025 against an invoice of January 2024 remains claimable until 30 November 2026. This delinking rescues many price-escalation and rate-difference credits that would otherwise appear time-barred, and it is worth checking before writing off any debit note credit as lost.
I heard old ITC demands for 2017-18 to 2020-21 were given relief. What is Section 16(5)?
The Finance (No. 2) Act 2024 inserted Section 16(5) retrospectively, allowing ITC for financial years 2017-18 to 2020-21 if it was claimed in a GSTR-3B filed on or before 30 November 2021, even though it breached the original Section 16(4) deadline. Section 16(6) gives similar relief for returns filed after revocation of a cancelled registration. Where demands were already confirmed on this ground, a special rectification procedure was notified for taxpayers to have such orders corrected. Not any more. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it.
