Notification No. 75/2018-Central Tax dated 31.12.2018 · 2018-12-31

This notification waived the late fee under section 47 for registered persons who failed to furnish FORM GSTR-1 for the months or quarters from July 2017 to September 2018 by the due date, provided the pending returns were furnished between 22 December 2018 and 31 March 2019. It was an amnesty aimed at bringing dormant and defaulting registrations back into the return filing system.

Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.

Practical effect: When reversing a disputed credit, extract the daily credit ledger balances, since a consistently adequate balance defeats the interest demand entirely.

You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Which food items became completely tax-free under GST 2.0?
From 22 September 2025, UHT milk, pre-packaged and labelled paneer and chena, and all Indian breads including roti, chapati, paratha and khakhra attract nil GST.
