The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.
What to do about it: Where a foreign principal owns the warranty obligation and pays you for honouring it, the recovery can be defended as an export of service.

CBIC clarified that consideration for export of services received in Indian rupees through Special Rupee Vostro Accounts, as permitted by the RBI for trade with countries such as Russia and Sri Lanka, satisfies the condition of receipt in convertible foreign exchange under the IGST Act. Such transactions therefore qualify as zero-rated exports, preserving the exporter's entitlement to supply under LUT without tax and to claim refunds of accumulated input tax credit.
Why this matters: Service exporters billing in rupees through RBI-approved Vostro arrangements should not be denied LUT or refund benefits, and this circular is the answer to any such objection.
49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
What to do about it: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.
