Volvo-Eicher Commercial Vehicles Ltd — AAAR Karnataka, order dated 6 February 2020 (appeal from AAR Karnataka, Advance Ruling No. KAR ADRG 32/2019, dated 12 September 2019) · 2020-02-06
The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.
Practical effect: Where a foreign principal owns the warranty obligation and pays you for honouring it, the recovery can be defended as an export of service.
Notification No. 04/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13
This notification amended the services exemption list to give effect to the 47th Council's decisions. Entry 12, which exempted renting of a residential dwelling for use as residence, was made subject to the condition that the recipient is not a registered person. The notification also withdrew the exemption for hotel accommodation priced up to one thousand rupees per unit per day and the value-based exemptions for small freight consignments carried by goods transport agencies. The changes took effect from 18 July 2022.
Practical effect: A Chennai landlord letting a flat to a GST-registered firm no longer supplies an exempt service, and the tenant must account for the tax under reverse charge.
49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
What to do about it: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.
