A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.

Issued alongside the Rule 164 amendment, this circular settles the position that tax already paid through GSTR-3B before 1 November 2024 towards a disputed demand counts as payment for the Section 128A waiver, even though Rule 164 otherwise contemplates payment through Form DRC-03 or against the demand order. It gives field formations the procedural guidance for accepting such earlier return-based payments when processing SPL-01 and SPL-02 applications.

What to do about it: Do not abandon an amnesty application merely because the tax was paid earlier through returns rather than DRC-03; that payment counts towards the waiver.

Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. Motorcycles up to 350cc are at 18 percent, while those above 350cc attract 40 percent. Electric vehicles continue at a concessional 5 percent. Dealers must also apply these rates to demo vehicle sales.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. So a Vanagaram trainer running a workshop in Hyderabad for a registered Chennai company charges CGST plus SGST of Tamil Nadu, but the same workshop sold to unregistered individuals is taxed in Telangana. I returned an advance because the deal was cancelled. What document do I issue?

Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Vanagaram buying stationery from an unregistered shop has no Section 9(4) liability at all.
Who must sign GST filings with a DSC, and who can use EVC?

Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
