Taxpayers with aggregate turnover of Rs 5 crore or more in the previous financial year continued to file by the 20th. Smaller taxpayers were split by State: those in Tamil Nadu and the other southern and western States were given the 22nd, while the northern and eastern States were given the 24th. The arrangement was first notified for the January to March 2020 returns.

Practical effect: A Chennai business below Rs 5 crore turnover files GSTR-3B by the 22nd, not the 20th, and late-fee notices computed from the 20th should be contested.

Mandarina Apartment Owners Welfare Association v. Commercial Tax Officer/State Tax Officer — Madras High Court, W.P. Nos. 15307 and 15330 of 2024, 2024:MHC:2708, decided 16 July 2024 (Senthilkumar Ramamoorthy J.) · 2024-07-16

The Madras High Court held that where discrepancies are noticed while scrutinising returns under Section 61, issuing Form GST ASMT-10 is mandatory; however, the absence of an ASMT-10 does not by itself vitiate subsequent proceedings under Sections 73 or 74. On the facts the assessment orders were set aside and remanded so that the taxpayers could file replies and be heard, the Court preferring substantive procedural fairness over a purely technical outcome.

What it means for you: Raise the missing ASMT-10 as a ground in your reply, but do not rely on it alone — build the case on merits and on absence of hearing as well.

The GST Appellate Tribunal's e-filing portal at efiling.gstat.gov.in became operational on 24 September 2025, finally giving taxpayers a forum for second appeals against orders of appellate and revisional authorities. Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

What to do about it: List every unfavourable appellate order your business holds and calendar the GSTAT filing windows now, since the backlog window closes on 30 June 2026 and missed tribunal deadlines forfeit the appeal remedy.

I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. How will I be informed of the GST audit findings?

I received Form DRC-07 after an adjudication order. What happens next?

Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
