The Supreme Court held that a rule prescribing a period within which credit must be taken from the date of the invoice does not take away any vested right. It merely regulates the manner and time of availing the credit, which the legislature is entitled to do. A taxpayer who fails to take the credit within the prescribed window loses the benefit. This reasoning supports the time limit in Section 16(4) of the CGST Act.
Why this matters: Chennai businesses should reconcile purchase registers with GSTR-2B every month and claim credit within the deadline, as belated claims are generally lost.
Notification No. 19/2021-Central Tax · 2021-06-01
For the tax periods July 2017 to April 2021 the late fee on GSTR-3B was capped at Rs 1,000 per return, being Rs 500 each under the central and State laws, and at Rs 500 per return where the return was a nil return. The concession applied to returns furnished between 1 June 2021 and 31 August 2021. The same notification rationalised the late fee prospectively from June 2021, capping it at Rs 500 for nil returns, Rs 2,000 where turnover is up to Rs 1.5 crore, Rs 5,000 where turnover is between Rs 1.5 crore and Rs 5 crore, and leaving the normal Rs 10,000 ceiling for turnover above Rs 5 crore.
Why this matters: This scheme let a Chennai business clear four years of pending returns for a few thousand rupees, and it also fixed the low late fee ceilings that small taxpayers still enjoy today.

For online services supplied to unregistered persons, including OIDAR services, online gaming and subscriptions, CBIC clarified that the supplier must record the recipient's State on the tax invoice, which is then deemed the address on record for determining place of supply under Section 12(2)(b). Failure to collect and record the State means incorrect place of supply, wrong apportionment of tax between States, and exposure to penal action under Section 122(3)(e).
What to do about it: Any business selling digital services or subscriptions to consumers must capture the customer's State at checkout and print it on invoices, or face penalties and tax reallocation disputes.
