Goodwill Industrial Canteen - AAR Tamil Nadu, Order No. TN/09/AAR/2018, dated 30 August 2018 · 2018-08-30

The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

Notification No. 11/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

This notification amends the 2017 concessional rate notification for goods supplied to holders of petroleum exploration licences and coal-bed methane contracts, substituting the entry in the rate column with nine per cent central tax, that is eighteen per cent combined, with effect from 22 September 2025. The concessional scheme survives but at the standard rate, so the practical benefit is now limited to items that would otherwise attract a higher rate under the main schedule.

Practical effect: Vendors supplying oil and gas exploration projects should update contract rate clauses to eighteen per cent for supplies made on or after 22 September 2025.

Clarifying the new clause (ca) of Section 10(1) of the IGST Act, CBIC stated that when goods are supplied to an unregistered person and the billing address differs from the delivery address, the place of supply is the delivery address recorded on the invoice. This principally affects e-commerce transactions, where a buyer may bill in one State and ship to another, and determines whether the seller charges CGST-SGST or IGST.

Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9.
