Circular No. 31/05/2018-GST dated 9 February 2018 · 2018-02-09

CBIC assigned the proper officers for issuing show cause notices and orders under sections 73 and 74 of the CGST Act and section 20 of the IGST Act, with monetary limits based on the central tax and integrated tax involved. Superintendents were empowered for smaller demands, Deputy or Assistant Commissioners for the middle range, and Additional or Joint Commissioners above that. The circular was later amended by Circular No. 169/01/2022-GST.

What to do about it: When a DRC-01 arrives, check whether the officer who signed it had jurisdiction over that amount, because a notice issued beyond the monetary limit is open to challenge.

The nil-rate list narrowed to goods that are not pre-packaged and labelled

Notification No. 7/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13

This companion notification amended the exemption list so that the nil rate on cereals, pulses, flour and similar staples applies only where the goods are other than pre-packaged and labelled. Loose sale from an open sack or gunny bag remains exempt; the same commodity in a sealed retail pack bearing statutory declarations becomes taxable at five per cent. Both notifications came into force on 18 July 2022 and reshaped billing for every kirana and provision supplier.

What to do about it: The same bag of rice is nil-rated if sold loose and taxable at five per cent if sold in a labelled retail pack, so packing practice now decides the tax.

Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. What imprisonment terms does GST law prescribe, and which offences are non-bailable?

Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Villivakkam with paid-but-open demands should file DRC-03A promptly.
